WASHINGTON - U. S. District Judge Michael G. Casey, sitting without bail for a multistate case, has ordered a federal jury to unseal documents and other documents in an attempt to shut down an Internet drugstore chain that illegally marketed its popular erectile dysfunction drug Viagra.
In the case, which is based in the District of New Jersey, the defendants are suing the online drugstore and its affiliated Web site for allegedly conspiring to conceal and delay their sale of the erectile dysfunction drug in order to delay its approval for use.
In the suit, plaintiffs allege that the defendant web site offered and sold Viagra on the Internet and marketed it to its customers through "pharmacies and websites" in violation of the Internet Ordering the Drug. The defendants allege that the online site was not only operating illegally but also encouraged customers to purchase it through its Web site.
"The Internet Ordering the Drug may not have been a convenient way to facilitate the sale of Viagra, but it is an illegitimate way to do business with the Internet," said United States Attorney General John V. Footnote 2. "The defendants' conduct is a blatant violation of the federal Food, Drug, and Cosmetic Act, which prohibits the public from making, using, or advertising, or receiving, any information about the sale or use of any drug or medicine."
The suit seeks to halt the defendants' conduct and to prevent others from making such offers.
"To date, the defendants have not shown that they were not making an illegal and convenient way to obtain Viagra and their actions are a blatant violation of the Food, Drug, and Cosmetic Act," said the Justice Department's Department of Justice, which is investigating the case. "In this case, the defendants are seeking to stop the illegal conduct from being resumed and to prevent others from selling their products."
The defendants face $2.5 million in damages for the civil and criminal violations, which they are trying to bring to a federal court.
The suit was filed by a group of about 20 people who were trying to stop the defendants from selling their popular erectile dysfunction drug Viagra online.
The complaint also includes an online video, which the defendants are trying to use to promote the online drugstore.
The video was released through a video game that defendants say played on their computer and was also posted on their social media accounts. In that video, customers can see Viagra on a variety of different tablets and other products, including the popular erectile dysfunction drug.
In a statement released by the defendants, a spokesman for the drugstore said the company does not sell Viagra on the Internet or in any other manner, but customers are told to "stop using the product."
In an email to The Associated Press, a spokesman for the company said: "We have a number of online pharmacies and we offer it to customers on behalf of customers. The companies are offering to sell the medication in our stores. We will take a look at that."
